Terms of Service

These Terms govern your use of ClaimDraft PA (the "Service"), operated by Empowered Solutions Ltd ("we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service is offered solely to public adjusters who hold an active license in the state(s) in which they operate. Access requires completing a public adjuster license attestation in which you represent that your license is current and in good standing and that you are using the Service in the course of your own licensed practice.

You must keep that attestation accurate. If your license lapses, is suspended, or is revoked, you must stop using the Service and notify us. We may suspend or terminate access if an attestation appears inaccurate.

ClaimDraft PA provides analytical assistance only. It reads a carrier's estimate against a policy and surfaces potential gaps, omissions, and provisions for your consideration.

The Service does not perform public adjusting services, does not represent policyholders, does not adjust or negotiate claims, and does not provide legal advice, coverage determinations, or professional opinions. Nothing the Service outputs is a coverage decision or a legal conclusion. We are not your attorney and we are not a party to your engagement with any client.

You are solely responsible for reviewing, verifying, and exercising independent professional judgment on every finding before you rely on it, share it, or use it in any communication with a carrier, client, or third party. AI-generated analysis can be incomplete or wrong, including with respect to policy language, coverage, scope, and pricing.

You are responsible for the accuracy of the documents you upload, for having the right to upload them, for compliance with the licensing, advertising, and conduct rules that apply to your practice, and for all output you adopt as your own work.

Do not use the Service to misrepresent your licensure, to provide adjusting services you are not licensed to provide, to submit documents you are not authorized to submit, to attempt to reverse-engineer or resell the Service, or in violation of any applicable law.

Paid plans are billed in advance for the applicable term and are non-refundable except where required by law. You may cancel at any time; cancellation takes effect at the end of the current billing period.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, complete, or that any analysis will produce a particular claim outcome.

To the maximum extent permitted by law, Empowered Solutions Ltd will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost claim value, or lost business, arising out of or relating to the Service. Our total aggregate liability is limited to the amounts you paid us for the Service in the twelve months preceding the claim.

You agree to defend, indemnify, and hold harmless Empowered Solutions Ltd and its officers, directors, employees, and agents from and against any claims, demands, actions, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• any misrepresentation regarding your public adjuster licensure or the accuracy of your attestation;
• your misuse of the Service, including use of any output without independent professional review;
• your violation of these Terms, of applicable licensing or insurance regulations, or of the rights of any third party, including any policyholder or carrier.

How we handle your documents and personal information — including that document content is processed by Anthropic's Claude API to generate your analysis — is described in our Privacy Policy, which forms part of these Terms.

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms, inaccurate license attestation, non-payment, or conduct that creates legal or security risk.

We may update these Terms. Material changes will be posted here with a revised effective date and communicated to account holders. Continued use after the effective date constitutes acceptance.

These Terms are governed by the laws applicable to Empowered Solutions Ltd's place of organization, without regard to conflict-of-laws rules.
